FITNESS AND SPECIAL REQUIREMENTS (eg. MEDICAL, DIETARY):

Please disclose your level of fitness and any special needs you have and read and agree to our Travel Participation Waiver. You do not need to disclose any special needs, which will not impact on the Tour, however if you do not disclose these needs then they cannot be accommodated for and your ability to participate fully in the Tour may be affected. You acknowledge that some tours or tour activities require a good level of fitness and/ or will not be suitable for persons with disabilities and in order to protect the health, safety or property of other participants, including you, Travelling Divas may have to decline your request to join the Tour or to do some Tour activities. By submitting a Booking Form to join this Tour you are acknowledging the physical demands and hazards involved in the Tour and have chosen to participate at your own risk.

Terms and conditions

These tour specific terms and conditions must be read in conjunction with the Travelling Divas standard terms and conditions.

Travelling Divas is acting as a sales agent only not the operator of this tour. We provide the programme on the basis of booking conditions below, provided by Lane Change Escapes as the operator of this experience, combined with Travelling Divas’ Standard booking conditions.

A non-refundable deposit of AUD 1,000.00 per person is payable following a ‘confirmation of booking request’ outlining payment information.

Full payment is due 14 days prior to the Escape start date (15 April 2021)

If the participant withdraws or transfers from the escape, the following refund policy applies:

If the participant withdraws 90 days or more prior to escape commencement the participant will be refunded any amounts paid over and above the non-refundable trip deposit.
If the participant withdraws 60-89 days prior to the escape commencement the participant will receive 75% minus the non-refundable escape deposit.
If the participant withdraws 30-59 days prior to the escape commencement the participant will receive 50% minus the non-refundable escape deposit.
If the participant withdraws 29 days or less prior to the escape commencement the full escape fee is non-refundable.
If the participant withdraws due to a;
1. COVID 19 Government enforced lockdown due in their area and/or
2. A (theirs or a close contacts) positive COVID 19 test result

The participant will be refunded any amounts paid, including the non-refundable deposit. The participant must provide sufficient evidence to support their inability to attend the escape.

All refunds will be paid in Australian dollars as per the cost of the escape listed on https://www.lanechange.com.au/ . Lane Change Escapes is not responsible for any financial loss incurred as a result of currency exchange rates.

If Lane Change Escapes cancels the escape, all monies paid into Lane Change Escapes at the date of cancellation will be refunded. Lane Change Escapes nor Travelling Divas will not be responsible for any additional travel or other costs incurred and associated with the participant’s travel.

Participants must have travel insurance and confirm details to Lane Change Escapes no less than 7 days prior to the escape commencement date.

Each participant must complete a Medical Disclosure Form that will be sent to them via email and must be returned no later than 14 days before escape commencement. Each participant must hereby acknowledge that the escape will include physical activity that may present personal risks to himself/herself and other members of the group.

If the participant arrives at the escape with any cold, flu or COVID 19 symptoms and have not obtained a COVID 19 test with a negative result, the participant will be asked to leave the escape for the safety and welfare or other guests. The participant will not be refunded any amounts paid. It is the participant’s responsibility to take the necessary measures to ensure they are healthy and well prior to the escape.

Lane Change reserves the right to change or amend this policy at any time. The current policy is always applicable.

Travel to and from Pearl Beach is under own arrangements

The property offers 5 bedrooms and 3 bathrooms, so some bathroom facilities will be shared. Anti – bacterial wipes and sanitiser will be provided. Please note this is guesthouse accommodation so daily housekeeping is not provided during your stay.

A willing to share option is not available during COVID.

You will be required to provide a COVID declaration with 72 hours of commencement.

In consideration of Travelling Divas allowing you to travel on the above tour, you acknowledge and agree that:

You provide this waiver to Travelling Divas, the business owned by Powis Consulting as Trustee for The Powis Trust ABN 24 049 272 152, that entity and that entity’s related parties including subcontractors (“Travelling Divas”) who are involved in organising and providing the tour and services you have requested in connection with travelling.
You waive certain legal rights and have read this waiver carefully.
You are fit to travel and know of no health condition or reason why doing so would pose any risk to the health, safety or property of travellers, including you.
You freely accept that you are solely responsible for your own physical and emotional health and fully accept the risks, dangers and hazards involved in the tour and tour pace and that participating may activate or aggravate pre-existing injuries, conditions, or congenital defects.
You are aware that the tour may involve: personal injury and/or death, travel to remote areas without access to medical facilities or treatment, changing weather conditions, interactions or encounters with wildlife, equipment malfunctions, negligence of other travellers or guides, negligence on the part of Travelling Divas, including failure to safeguard or protect from the risks or dangers of the tour activities, consumption of alcohol, collisions with vehicles, equipment, or structures, becoming lost or separated from guides or other travellers, and the failure to remain within designated areas.
You are not relying on any oral or written representations or statements made by Travelling Divas about the safety of the tour or tour activities other than what is stated in this Waiver.
Travelling Divas is not liable if a particular health condition exacerbates while on tour or affects your ability to participate in the tour or any tour activity.
You are familiar with the health requirements specific to the countries being visited and have been vaccinated for travel to that country as recommended by a registered medical practitioner.
You have discussed any pre-existing health conditions or specific health concerns with a medical practitioner and followed their advice.
You will provide Travelling Divas in writing with relevant information on any health condition, dietary requirement/food allergy, or disability, which may affect you while travelling, and if that information changes will immediately inform Travelling Divas in writing of that new information. Pregnancy is considered a health condition.
If requested, you will provide Travelling Divas with information or professional medical opinions, as determined in its discretion, for your safety or the safe operation of a tour and tour activities. Further you agree that Travelling Divas has the right to cancel your booking or deny you permission to participate in any aspect of a tour at any time and at your own risk and expense where it is decided that your physical or mental condition renders you unfit for travel or you represent a danger to yourself or others.
In some destinations seatbelts are not compulsory by law and local operators may or may not have seatbelts in vehicles or available for use. Where this is the case, you acknowledge that seatbelts may not be available and you will travel in vehicles at your own risk. You warrant that you shall not make any claim howsoever arising from injury or damage in respect of, arising from or contributed to by the absence of seatbelts and hereby release Travelling Divas from all such claims.
That in the event you or your next of kin, suffer any loss, damage, expense, or injury from my participation in the tour or tour activities including those caused by the risks in this waiver, your waive any and all claims your have or may have in the future against Travelling Divas and release Travelling Divas from any and all liability.
To hold harmless and indemnify Travelling Divas from any and all liability for damage to property or personal injury to any third party resulting from my participation in the tour and tour activities.
